Realize Conference 2020

Thank you for registering for WalkMe Realize, The Digital Adoption Conference (“Realize”). These Terms and Conditions (“Terms”) govern your registration to and participation in Realize, to be held on March 10-11, 2020, in San Francisco, California.

These Terms constitute an agreement between you (the individual accepting these Terms – and if applicable, the company or legal entity for which you are accepting these Terms) or the individual attending Realize and WalkMe, Inc., a Delaware corporation with offices at 71 Stevenson St., 20th Floor, San Francisco, CA 94105 USA (“WalkMe”). 

These Terms shall apply when you register for Realize at www.realizedap.com, so please read the Terms carefully. 

Realize is organized by WalkMe, which reserves the right, in its sole discretion, to limit or deny access to any entity or individual for any reason. To be eligible to participate in Realize, you must be 21 years or older.  Due to the limited availability of tickets, we are currently giving preference to WalkMe prospects, customers and partners. 

1. Privacy Notice. 

In order to attend Realize, you must be registered and thereby provide certain required registration information, which may include your personal information (namely, first and last name, company, address, job title, email address, phone number). 

If you register and purchase tickets for yourself and other guests, we remind you that you are – and remain solely responsible – for providing your guests with the present Terms, and any other terms and conditions which may apply to the participation in Realize, and obtaining their consent with such terms prior to your registration and purchase. In addition, should you register and purchase for other guests, you are and remain solely responsible for obtaining – as required by the applicable law – your guest’s permission to provide their personal information to WalkMe.  

You hereby give your consent for WalkMe to collect, process, and use your personal information for the purpose of processing your and your guest’s registration for Realize and redeem your badge as detailed below. Such personal information will be used for the purpose of processing ticket sales and compiling attendee lists, which may be shared with WalkMe partners (also known as “Sponsors”). For an updated list of sponsors, please check out www.realizedap.com. WalkMe may use service providers to facilitate the registration process, and storage of your data.

You furthermore provide your consent for WalkMe and its agents to use your personal information for the purpose of commercial, marketing and advertising purposes, amongst others, by contacting you by email, phone or other communication channels about WalkMe products and services, including, but not limited to, product releases, updates, seminars, events, special offers, sales and marketing emails, newsletters and social media messages. 

WalkMe shall collect, process and use your personal information in accordance with WalkMe’s Privacy Policy available at: https://www.walkme.com/privacy-policy/ (WalkMe Privacy Policy). 

WalkMe shall use your personal information as collected through the registration process and your browsing on www.realizedap.com, only as detailed in this notice and WalkMe’s Privacy Policy. Other then as listed herein, we do not sell or transfer your Personal information to third parties.

Please note you may always revoke your consent provided herein, by using the unsubscribe button in any e-mail communication sent to you, by sending an email to realize@walkme.com or by using the “Do Not Sell My Personal Information” opt-out at www.realizedap.com. 

Please note, however, that such opt-out shall not apply to emails required to be sent by WalkMe in order to provide you with relevant information regarding your entry to Realize (i.e. sending you an e-ticket confirmation). Please note that subcontractors may process your data such as WalkMe’s data storage provider – for more information see WalkMe’s Privacy Policy. 

Subject to applicable law, you have the right to (i) request access to your personal information (which WalkMe will provide within 45 days in a portable and easily accessible format), (ii) request to delete your personal information or (iii) ask us not to sell your information. WalkMe will never discriminate, provide you with a different level of quality or service, charge you with a different price or deny you goods or services, for exercising your legal rights, unless permitted by applicable law. Please note however that certain details are required in order to provide you with the services detailed herein and therefore cannot be deleted.

Should you wish that WalkMe deletes your personal information, you must request WalkMe to do so in writing, by sending an email to: legal@walkme.com or provide notice to: Legal Department, 71 Stevenson St., 20th Floor, San Francisco, CA 94105 USA, or call: 1-855-4WALKME (925563 – Toll Free Number).

If you have any questions (or comments) concerning this privacy notice, you are welcome to send us an email or otherwise contact us at the contact details provided above. WalkMe will make an effort to reply within a reasonable timeframe.

2. Payment.

Full payment of the admission fees (“Fees”) is required to gain access to Realize. The Fees may only be used for Realize 2020 and may not be applied towards the purchase of other WalkMe products, services, or events. By completing the payment, you accept the Terms of the relevant payment provider and WalkMe assumes not liability. If you pay with credit card, WalkMe or its authorized agent is hereby authorized by you to charge your credit card for Fees associated with Realize. 

If you are eligible for any promocodes, please note that such promocodes cannot be transferred.

You will receive an e-mail confirmation upon completion of the registration delivered to the email address indicated by you during the registration.

WalkMe retains the right to reject any ticket purchase within maximum 7 days after payment. If this happens, WalkMe will refund the full price of the ticket.  

3. Badges.

Your email confirmation functions as a receipt for the transaction and can be used to redeem your badge at the Realize venue. Badges will indicate your authorized access to Realize, venue areas and sessions, and must be worn at all times during Realize. Badges can be picked up at City View at Metreon, San Francisco (the “Venue”). A photo ID or passport will be requested when you collect your badge at the Venue. You may be denied access with no refund, if you do not provide such identification upon request. 

Sharing with or transferring your badge to someone else is not permitted at any time, and as a consequence, WalkMe may deny your admittance upon no refunds. 

WalkMe will provide Sponsors with their own badge scanning device at Realize. Please note that if you choose to have your attendee badge scanned by a Sponsor at Realize, subject to applicable law, WalkMe will share your name and contact details with that Sponsor. WalkMe is not responsible for such scanning. When you agree to have your badge scanned by a Sponsor, you are consenting to allow that Sponsor to use your contact information to communicate with you about their services. We remind you that scanning of badges is optional, and you are free to refuse (without penalty) to have your badge scanned. If you have questions on how the sponsor will handle your information, please reach out directly to the Sponsor, or refer to its privacy policy.

4. Cancellation.

If your circumstances change, or you can no longer attend Realize, you may cancel your registration by providing written notice to WalkMe at realize@walkme.com before February 10, 2020 (“Cut-off date”). If you cancel before the Cut-off date, WalkMe shall refund your registration.  Cancellations received after the Cut-off date for any reason or nonattendance, will not be refunded by WalkMe. The Fees shall remain due in full, if cancellations were received after the Cut-off date with balance due. 

At your option, you may also transfer your registration to another person by contacting WalkMe at realize@walkme.com until February 24, 2020. 

WalkMe retains the right to change the agenda without prior notice and will not be liable for canceling or rescheduling Realize for any reason. WalkMe shall not be responsible for your costs in connection with travel and/or hotel arrangements if WalkMe cancels Realize. 

In case WalkMe cancels Realize due to force majeure after the Cut-off date, i.e. an event beyond WalkMe’s reasonable control which makes the performance of WalkMe’s obligations under these Terms impossible, impracticable or unsafe, such as: an act of God, fire, strike, national state of emergency, epidemic, natural disasters, or an act or threat of terrorism, failure of technical facilities and/or failure or substantial delay in transportation facilities, WalkMe shall not provide a refund.  

If you fail to comply with the Terms herein, WalkMe retains the right to refuse your registration, in which case, no refund of your registration shall be provided. 

Please remember that you are responsible for cancelling your own hotel and travel reservations in case your registration is cancelled for any reason. 

Other than as detailed above, WalkMe shall not refund your registration, and WalkMe shall not be responsible for your costs in connection with travel and/or hotel arrangements in case WalkMe or you cancel your registration. 

5. Media.

During the course of your participation at Realize, you may be photographed and/or recorded by video. The resulting images and/or associated media content are the property of WalkMe and may be displayed on the WalkMe website, and or other media/channels (i.e. WalkMe’s social media) for the purpose of marketing. If you do not agree to such publication, please send an email to realize@walkme.com. You furthermore understand, that your image may appear in Realize photos that are made available to you, other attendees or the public, and that these third parties may retain and distribute such photos.

6. Third Party Services.

To the extent you use third party services and facilities at Realize or in connection with Realize, you agree to comply with the terms and conditions required by those third parties. 

7. Code of Conduct. 

WalkMe will manage and organize Realize in good faith, and in conformity with applicable industry standards. WalkMe furthermore adheres to its internal policies of corporate ethics, and WalkMe acknowledges that its customers and partners adhere to similar policies.

Please respect the following conduct guidelines:

  • Maintain a respectful, considerate and courteous attitude towards all participants at Realize, online and at the Venue itself;
  • Secure your belongings; WalkMe shall not be liability in case of loss, damage or theft of your personal belongings;
  • Notify WalkMe promptly in case you detect or suspect situations or behavior that could be dangerous or otherwise harmful;
  • Provide clear, valuable and honest information.

Please do not:

  • Conduct marketing or other commercial activities without WalkMe’s consent;
  • Discriminate, harass, disrespect, impair or threated those you engage with online, or at the Venue in connection with Realize;
  • Post content in connection with Realize without the permission of the copyright owners.

If you have been (or notice someone has been) impacted by someone failing to adhere to these conduct guidelines, please contact WalkMe at realize@walkme.com or reach out to WalkMe’s staff present at the Venue.

Unacceptable behavior will not be tolerated at Realize. Anyone who is engaged in unacceptable behavior may result in suspension or admission denial without refund. This may also result in a prohibition from registering or attending future WalkMe events or conferences.

8. Security.

WalkMe reserves the right to take any security measures it deems appropriate to increase and maintain the safety of Realize participants and exhibitors, without prior notice. For example, bags may be checked randomly during certain hours. No bags or property should be left unattended at any time. Unattended property may be removed. Items prohibited at Realize include firearms, other weapons, explosives, and other hazardous materials or articles. If you do not comply with WalkMe’s security measures, you may be denied admittance without refunds.

9. Warranties.

To the extent permitted by the applicable law, WalkMe makes no warranties of any kind with respect to Realize or the Realize registration, whether express, implied or statutory or otherwise, and WalkMe specially disclaims all implied warranties, including any warranties of merchantability or fitness of a particular purpose.

10. Indemnification. 

You agree to defend, indemnify and hold harmless WalkMe harmless against any third-party claim, proceeding, loss, liability, or damage, including reasonable attorney’s fees arising from your participation in Realize and WalkMe affiliated activities and services. 

11. Limitation of liability. 

WalkMe will not, under any circumstances, be liable to you for any indirect, special, incidental, consequential or punitive damages, however caused, whether in contract, tort or under any other theory of liability, and whether or not you have been advised of the possibility of such damages. WalkMe’s liability of all kinds arising out of or related to Realize or these Terms, regardless of the forum or whether any action is based on contract, tort or otherwise, shall not exceed the amount paid by you to attend Realize, or $1,000.00, whichever is greater.

 12. Changes to these Terms.

WalkMe may make changes to these Terms from time to time. WalkMe will indicate the date on which the Terms were last updated on the first page of these Terms. An up-to-date version of these Terms remains available at www.realizedap.com. You understand and agree, that if you participate in Realize after the date on which the Terms were changed, your participation will be subject to the updated Terms.

13. Governing Law & Jurisdiction. 

These Terms are subject to the laws of the State of California, without regard to their conflict of laws rules or the United Nations Convention of International Sale of Goods. Both parties hereto agree to the exclusive to the exclusive jurisdiction of the courts in San Francisco, California, to adjudicate any disputes arising out of or relating to these Terms.

14. Miscellaneous.

No failure or delay by either party in exercising any right under these Terms constitutes a waiver of that right. Other than as expressly stated herein, the remedies provided herein are in addition to, and not exclusive of, any other remedies of a party at law or in equity.

You may not assign any of your rights or obligations hereunder, whether by operation of law or otherwise, without the prior written consent of WalkMe. WalkMe may assign these Terms, in whole or in part, as necessary for the execution of Realize without your consent and at its sole discretion. 

Subject to the foregoing, these Terms shall bind and inure to the benefit of the parties, their respective successors and permitted assigns. 

These Terms constitutes the entire agreement between the parties in relation to the Realize and registration for Realize and supersedes all prior and contemporaneous terms, agreements, proposal or representations, written or oral, concerning the subject matter.
